Terms of Service

These Terms of Service (“Terms”) form a binding contract between you and AI Image Detector (“AI Image Detector”, “we”, “us”). AI Image Detector is operated as an independent sole proprietorship; “AI Image Detector” refers to that sole proprietorship and is the legal counterparty under these Terms. The Terms govern your access to and use of aiimagedetector.info, our APIs, and all related features (the “Service”). Please read them carefully. By creating an account, signing in, or otherwise using the Service, you accept these Terms and our Privacy Policy and Refund Policy.
If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization, in which case “you” refers to that organization.
1. Acceptance of these Terms
You accept these Terms by (a) clicking an “I agree” button, (b) creating an account, or (c) using the Service. If you do not agree, do not use the Service.
2. Definitions
- Account — your individual user account on the Service.
- Credits — the unit of metered usage of the Service.
- Plan Credits — credits granted under a Subscription that expire at the end of each billing cycle.
- Top-up Credits — credits purchased as a one-time pack that do not expire.
- Free Credits — credits we grant for free (e.g. welcome credits, promotions).
- Subscription — a recurring monthly or yearly paid plan.
- Inputs — the image files you upload for analysis.
- Report — the forensic screening report we return for an Input, including per-signal results and a graded conclusion.
- Detection Provider — Sightengine, Copyleaks, Winston AI, Replicate, and any other third-party analysis service we use to produce Reports.
3. The Service
The Service analyzes images you upload (JPEG, PNG, or WebP, up to 15 MB each, individually or in batches of up to 50) and produces a forensic screening Report. Each analysis runs several independent signals: verification of C2PA Content Credentials, EXIF and metadata forensics, two commercial AI-detection engines (Sightengine and Winston AI), and a vision-model visual inspection (Google Gemini 2.5 Flash via Replicate). The signals are aggregated into a graded conclusion: AI-proven, high risk, inconclusive, low risk, or camera-proven.
We are not the developer of the underlying detection engines, and our delivery depends on the Detection Providers' availability. If an engine fails to respond during an analysis, the Report is produced from the remaining signals and credits are automatically refunded per the Refund Policy. Reports are private to your Account unless you share the Report link; shared Report pages are marked noindex.
4. Eligibility
- You must be at least 13 years old to create an account.
- You must be at least 18 to purchase a paid Subscription or one-time pack.
- You may not use the Service if you are located in a jurisdiction subject to a US, UN, EU, or UK comprehensive embargo (e.g. Cuba, Iran, North Korea, Syria, the Crimea/DNR/LNR regions of Ukraine).
- You may not use the Service if you are listed on any sanctions list maintained by the US Treasury OFAC, UN Security Council, EU, or UK HMT, or are owned 50% or more by parties so listed.
- You may not use the Service if we have previously terminated your account, unless we expressly authorize you to return.
5. Your account
- Sign-in is via Google OAuth. We do not store passwords.
- You must keep your Google account secure. You are responsible for all activity on your AI Image Detector account.
- You may have only one personal account. Team plans, when offered, allow multiple seats per the plan's terms.
- You must notify us without delay at hello@aiimagedetector.info if you suspect unauthorized access to your account.
- You may delete your account at any time by emailing us.
6. Acceptable Use Policy
6.1 Permitted use
You may use the Service for personal, professional, editorial, educational, and commercial purposes within the limits of your plan, including screening images before publication, checking the provenance of images you receive, triaging user-submitted or student-submitted images for human review, and verifying your own work — always subject to the human-review obligations in §11.
6.2 Prohibited content
You may not upload, submit, or distribute through the Service:
- Child sexual abuse material (CSAM), or any sexualized depiction of minors. We report all such content to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
- Non-consensual intimate imagery, or sexually explicit content involving identifiable people without their explicit consent.
- Images you obtained unlawfully (e.g. hacked or stolen private photos) or that you have no lawful basis to submit for analysis.
- Other people's personal data embedded in or alongside uploads without their consent or another lawful basis.
- Malware, exploits, or files crafted to attack the Service or the Detection Providers (e.g. malformed files targeting parser vulnerabilities).
- Content whose possession or distribution is otherwise illegal in your jurisdiction or ours.
6.3 Prohibited conduct
You may not:
- Use the Service, or publish its Reports, to harass, defame, or publicly accuse an identifiable person of fraud or misconduct based solely on a Report (see §11).
- Use the Service to develop, calibrate, or market tools designed to evade AI-image detection.
- Reverse-engineer, decompile, scrape, or otherwise attempt to extract source code, model weights, or training data from the Service or any Detection Provider.
- Run automated requests, bots, or load tests against the Service except through APIs we expressly publish.
- Bypass or attempt to bypass our rate limits, welcome-credit restrictions, fingerprint, or IP throttle.
- Resell, sublicense, or redistribute Credits, raw API access, or reseller accounts at scale without our written permission. Sharing individual Reports via the built-in share link is allowed.
- Impersonate AI Image Detector, our staff, or another user, or present a Report as issued by anyone other than the Service.
- Interfere with the Service's integrity or performance, e.g. via DDoS, malware, or exploitation of vulnerabilities. Responsible security disclosure to hello@aiimagedetector.info is welcome.
- Use the Service in violation of export control or sanctions laws.
6.4 Enforcement
We may review specific uploads and Reports in response to abuse reports or as part of trust-and-safety operations. We may, in our sole discretion, take any of the following actions for a violation, without prior notice:
- Refuse to analyze a particular upload;
- Disable sharing of a particular Report;
- Suspend access to specific features;
- Suspend your Account pending review;
- Permanently terminate your Account and all associated Credits;
- Report to law enforcement where required by law.
7. Credits
- Every analysis Report costs 3 Credits as of the effective date. Current pricing is shown on the Pricing page and is subject to change with notice.
- New accounts receive 3 welcome Credits — enough for one full Report. There is no recurring free quota.
- Plan Credits are reset (overwritten, not stacked) at the start of each billing cycle and expire at the end of that cycle.
- Top-up Credits never expire.
- Spending order: Plan Credits first (since they expire), then Top-up Credits.
- Free Credits (welcome credits, promos) have no cash value and are non-transferable.
- If a commercial detection engine fails to respond during an analysis, 1 Credit per failed engine is automatically refunded; if the whole analysis fails, the full charge is automatically refunded. See Refund Policy.
- If your account balance is insufficient, analysis requests will be rejected with a clear error.
8. Subscriptions, billing & auto-renewal
- Subscriptions are billed in advance, in USD, by Stripe, on the calendar day matching your initial purchase. Current plans are shown on the Pricing page (as of the effective date: Pro at $19/month or $182/year with 300 Credits per month; Team at $59/month or $566/year with 1,500 Credits per month; one-time packs at $19 for 240 Credits).
- Auto-renewal. Your Subscription automatically renews at the end of each billing cycle until you cancel.
- Cancellation. You can cancel any time from the Stripe Customer Portal accessible via your Dashboard. Cancellation takes effect at the end of the current cycle; you keep access and Plan Credits until then.
- Yearly plans. Yearly plans are charged once for the full year, and Plan Credits drip monthly throughout the year.
- Failed payments. Stripe retries failed payments per its dunning settings. If recovery fails, your Subscription will be downgraded to free.
9. Tax, fees & pricing changes
- Prices are exclusive of tax. Stripe Tax may add VAT, GST, or sales tax based on your billing address.
- You are responsible for any other taxes or duties applicable in your jurisdiction.
- We may change prices for new Subscriptions at any time. For existing Subscriptions, we will give at least 30 days' notice before any price increase takes effect at the next renewal. You may cancel before the increase applies.
10. Intellectual property
10.1 Your Inputs
You retain all rights you have in your Inputs. You grant AI Image Detector and its sub-processors a worldwide, non-exclusive, royalty-free license to host, copy, transmit, transform, and process your Inputs solely to deliver the Service to you (including sending them to the Detection Providers to produce your analysis), prevent abuse, and comply with law. Your Inputs are not used to train our models, and we instruct Detection Providers not to use them to train theirs. This license terminates when you delete the Input or your Account, subject to retention required for legal or backup purposes.
10.2 Reports
Subject to your compliance with these Terms, we grant you a worldwide, non-exclusive, royalty-free right to use, download, reproduce, and share the Reports we produce for you, for personal, professional, and commercial purposes — always subject to the limitations in §11.
You are solely responsible for how you use a Report and for ensuring that your use does not infringe third-party rights, defame anyone, or violate law. Detection results are probabilistic and may be wrong; see §11 and §15.
10.3 Aggregated & anonymized data
We may use aggregated, anonymized, or de-identified data derived from Inputs and Reports (such as verdict distributions, engine error rates, average file sizes) to operate, secure, and improve the Service. Such data does not identify you and is not subject to confidentiality obligations to you. We do not use your Inputs or Reports to train AI Image Detector-owned models.
10.4 Our IP
The Service, including the AI Image Detector brand, logo, design, code, signal-aggregation and grading methodology, report format, and documentation, is owned by us or our licensors and protected by intellectual property law. Except for the limited rights expressly granted to you, we reserve all rights. You may not remove copyright notices or claim ownership of any portion of the Service.
11. Screening-result disclaimer — important
Reports produced by AI Image Detector are a screening aid intended to help you decide where to focus human review. They are not:
- A legal determination or certification;
- Proof that an image is or is not AI-generated;
- Proof of fraud, misconduct, or dishonesty by any person;
- Forensic evidence admissible in court without expert review;
- A substitute for human judgment.
Except where cryptographic credentials (C2PA Content Credentials) are present and verified, all results are probabilistic. Detection engines can and do disagree with each other; they miss images from new generators and sometimes flag authentic photographs. A “high risk” grade means the image warrants human review — it does not mean the image is AI-generated, and it says nothing about the intent or honesty of the person who supplied it. An “inconclusive” grade is an honest answer, not a malfunction.
You must not use a Report as the sole basis for accusations against any person, disciplinary or academic action, employment decisions, publication or takedown decisions, or legal proceedings.Before taking any action that could harm a person's reputation, livelihood, or legal position, you must obtain independent corroboration and human review appropriate to the stakes involved.
AI Image Detector disclaims all liability for any consequence arising from treating a Report as a definitive verdict rather than a screening aid.
12. Third-party services
The Service integrates Google (sign-in), Stripe (payments, when enabled), and the Detection Providers (Sightengine, Eden AI routing to Winston AI, and Replicate inference). Your use of those integrations is also governed by their respective terms and privacy policies. We are not responsible for changes, outages, or actions of those third-party services; engine outages during an analysis trigger the automatic credit refunds described in §7.
13. DMCA / copyright complaints
If you believe content on the Service infringes your copyright, send a notice to hello@aiimagedetector.info with the subject line [DMCA] containing:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material and information reasonably sufficient for us to locate it (URL, report ID, timestamp).
- Your contact information (name, address, phone, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the owner or authorized to act on the owner's behalf.
We respond to valid notices by removing the infringing content and notifying the user who uploaded it. Users may submit a counter-notice with the equivalent statutory information. We terminate accounts of users who are repeat infringers.
14. Privacy
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT ANY REPORT, GRADE, SCORE, OR OTHER OUTPUT WILL BE ACCURATE, COMPLETE, OR ERROR-FREE, OR THAT IT WILL CORRECTLY IDENTIFY WHETHER ANY IMAGE IS OR IS NOT AI-GENERATED.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI IMAGE DETECTOR AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATION, OR SUBSTITUTE-SERVICE COSTS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.
Some jurisdictions do not allow exclusion of certain warranties or limitations on certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
17. Indemnification
You agree to defend, indemnify, and hold harmless AI Image Detector and its affiliates, officers, employees, and agents from any third-party claim, damage, loss, or expense (including reasonable attorneys' fees) arising from (a) your Inputs, (b) your use of Reports — including any accusation, publication, or decision you base on them, (c) your violation of these Terms or applicable law, or (d) your infringement of any third-party right.
18. Suspension & termination
- We may suspend or terminate your Account immediately for violation of these Terms or for unlawful or abusive use.
- We may terminate inactive Accounts (no sign-in for 24 consecutive months) after giving you 30 days' email notice.
- You may terminate at any time by deleting your Account from the Dashboard or by emailing us.
19. Effect of termination
On termination: your access to the Service ends; unused Plan Credits are forfeit; Top-up Credits are forfeit unless refundable under the Refund Policy; we delete your data per the retention schedule in our Privacy Policy. Sections that by their nature should survive (definitions, IP, disclaimers, liability, indemnification, dispute resolution, governing law, general provisions) will survive termination.
20. Modifications to the Service
We may add, remove, change, or deprecate features — including individual detection signals or providers — at any time. We will give reasonable notice of material removals or breaking changes that affect paid users.
21. Modifications to these Terms
We may update these Terms from time to time. For material changes we will notify you at least 30 days in advance via email or in-app banner. Continued use of the Service after the new Terms take effect constitutes acceptance. If you object to a change, you may terminate your Account before the change takes effect.
22. Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet outages, third-party service failures (including Detection Providers, Stripe, Google, Vercel, Neon, Cloudflare), or pandemics.
23. Governing law
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply. Where mandatory consumer-protection law of your country of residence grants you additional rights, those rights are not waived.
24. Dispute resolution & arbitration
24.1 Informal resolution first
Before filing any claim, you and AI Image Detector agree to try in good faith to resolve the dispute informally for at least 60 days by emailing hello@aiimagedetector.info with a description of the dispute and the relief you seek.
24.2 Binding individual arbitration
If the dispute is not resolved within 60 days, you and AI Image Detector agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with the seat of arbitration in Delaware, USA. Judgment on the award may be entered in any court of competent jurisdiction.
24.3 Class-action waiver
YOU AND AI IMAGE DETECTOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims of more than one person.
24.4 30-day opt-out
You may opt out of §24.2 and §24.3 by emailing hello@aiimagedetector.info within 30 days of first accepting these Terms with the subject line [Arbitration opt-out] and including your full name and the email associated with your Account. Opting out does not affect any other part of these Terms.
24.5 Carve-outs
Either party may bring an individual action in small-claims court if eligible. Either party may seek injunctive relief in court for actual or threatened infringement of intellectual-property rights or unauthorized access. Nothing in this section prevents you from contacting a government agency.
24.6 EU / UK consumers
If you are a consumer resident in the EU, the United Kingdom, or Switzerland, the arbitration provisions in §24.2 and §24.3 apply only to the extent permitted by mandatory law in your country. You retain the right to bring claims in your local courts. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr; we are not contractually obligated to use it.
25. General provisions
- Severability. If any provision of these Terms is held invalid or unenforceable, the remainder will remain in full force.
- No waiver. Our failure to enforce a provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a merger, sale of assets, or reorganization.
- Notices. We give notice to you by email to the address on your Account, by posting on the Service, or in-app banner. You give notice to us at hello@aiimagedetector.info.
- Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service and supersede prior agreements.
- Headings. Headings are for convenience only and do not affect interpretation.
- Independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
